Please read these terms carefully before using SamVault. By creating an account or using our service, you agree to be bound by these terms.

1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and SamVault ("we", "us", "our") governing your access to and use of the SamVault document management platform, including all associated websites, applications, and services (collectively, the "Service").

By registering for an account, accessing the Service, or clicking "I agree", you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

If you are using the Service on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms.

2. Service Description

SamVault provides a secure, encrypted document management platform that allows users to upload, store, organise, access, and share digital documents. The Service includes:

  • Encrypted document storage using AES-256-GCM encryption
  • Document organisation by categories, tags, and folders
  • Secure document sharing via time-limited, one-time-code protected links
  • Document preview and download capabilities
  • Activity logging and audit trail features

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice to registered users.

3. User Accounts

Registration. To use the Service you must register for an account and provide accurate, current, and complete information. You agree to keep your account information up to date.

Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at security@samvault.com of any unauthorised use of your account.

Important – registered details: Your registered email address and phone number are linked to your account security. If you need to change either, you must contact support first to complete a guided account update process. Changing them independently may result in loss of access to your stored documents.

Age requirement. You must be at least 18 years of age to use the Service.

One account per person. Each person may maintain only one free account. Multiple accounts created to circumvent storage limits may be terminated without notice.

4. Acceptable Use

You agree not to use the Service to store, transmit, or share content that:

  • Violates any applicable law or regulation
  • Infringes any intellectual property rights of any third party
  • Contains malware, viruses, or any other malicious code
  • Is defamatory, obscene, hateful, or harassing
  • Constitutes unsolicited commercial communications ("spam")
  • Depicts or facilitates illegal activity

You also agree not to: attempt to gain unauthorised access to any part of the Service; interfere with or disrupt the Service; use automated tools to access the Service in a manner that could damage or impair it; or attempt to reverse engineer any aspect of the Service.

Violation of these provisions may result in immediate account termination and, where appropriate, referral to law enforcement authorities.

5. Your Data & Content

Ownership. You retain full ownership of all documents and content you upload to the Service ("User Content"). We do not claim any ownership rights over your User Content.

Licence to operate. By uploading User Content, you grant us a limited, non-exclusive, royalty-free licence to store, process, and transmit your User Content solely for the purpose of providing the Service to you.

Zero-knowledge. Because your documents are protected with strong encryption before they reach our servers, we are technically unable to access the content of your documents. Any processing of User Content is performed on encrypted data only.

Responsibility. You are solely responsible for the User Content you upload, including ensuring you have the legal right to store and share that content.

6. Encryption & Keys

SamVault uses a zero-knowledge encryption model. Your vault is protected by a unique encryption key that is generated based on your account details at registration. This key is never transmitted to or stored on our servers in a recoverable form.

Account recovery notice: Because your vault encryption is tied to your account identity and we do not retain a copy, it is not possible for SamVault to recover access to your encrypted documents if you permanently lose access to your registered account details. You are solely responsible for keeping your account details current.

In the event you need to update your phone number or email address, you must contact support in advance to undergo a guided account migration process. Attempting to change these details without support assistance may result in loss of access to existing documents.

7. Plans & Billing

Free plan. Free accounts include 5 GB of encrypted storage. We reserve the right to modify free plan inclusions with 30 days' notice.

Paid plans. Paid subscription plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by applicable law or as expressly stated in these Terms.

Upgrades and downgrades. You may upgrade your plan at any time; the change takes effect immediately. Downgrades take effect at the end of the current billing period. If your usage exceeds the limits of a lower-tier plan, the downgrade will be blocked until you reduce usage.

Payment. Payments are processed by our third-party payment processor. We do not store full payment card details on our servers.

Taxes. All prices are exclusive of applicable VAT and other taxes, which will be added where required by law.

8. Termination

By you. You may close your account at any time from your account settings. Upon closure, your encrypted data will be queued for deletion from our storage systems within 30 days.

By us. We may suspend or terminate your account immediately if you breach these Terms, if your account is used fraudulently, or if we are required to do so by law. We will provide reasonable notice where possible except in cases of serious breach.

Effect of termination. Upon termination, your right to access the Service ceases immediately. We accept no liability for the loss of data following account termination where the termination was caused by your breach of these Terms.

Data export. Before closing your account we recommend using the Export Vault Data feature in Security settings to download a copy of all your documents.

9. Limitation of Liability

To the fullest extent permitted by applicable law, SamVault and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business, arising out of or in connection with your use of the Service.

Our total aggregate liability to you in connection with these Terms shall not exceed the greater of (a) the total fees paid by you to us in the 12 months preceding the event giving rise to the claim, or (b) £100.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

10. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email to the address associated with your account and by displaying a notice within the Service at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and close your account before the effective date.

11. Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of India.

The courts of Haryana, India shall have jurisdiction to settle any dispute arising out of or in connection with these Terms, subject to applicable law. We reserve the right to bring proceedings in any jurisdiction where you have assets or reside.

If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, that provision shall be deemed severable from the remaining Terms and shall not affect the validity and enforceability of the remaining provisions.
